When a property owner dies, who can legally sign? If you don’t know the answer, you could risk delays, disputes, or lost deals. This class unpacks what every real estate agent and appraiser needs to know about probate, POAs, trusts, and intestate estates. Learn how to navigate legal authority, title issues, tax traps, and appraisal requirements so you can protect your clients—and your closings. If you're working with estates, this isn’t optional knowledge - it’s essential.
Learning Objectives:
- Know who has legal authority to act both before and after death for another person
- Understand why POAs end and what replaces them
- Learn the difference between dying testate (with a will) and dying intestate (without a will) as well as the difference between executors and administrators
- Appraisal tips and understanding of date-of-death valuations
- Identify must have documents for estate sales, and who has authority
- Recognize specific situations, e.g. trusts, incompetent individuals, strained family relationships
- Recall taxes and costs: estate taxes, estate tax returns, Medicaid look-back period, expenses for probate, timelines
- Recognize and implement in your practice auxiliary services, or recommendations (estate clean-out, hoarding situations, insolvent estates, etc.)

Melanie McLane is a second-generation REALTOR® who is an appraiser, broker, and educator. A graduate of Kenyon College in Gambier, Ohio, she is a certified as a distance instructor (CDEI) and is an Appraiser Qualifications Board-approved USPAP (Uniform Standards of Professional Appraisal Practice) instructor. She served as a subject matter expert/author for the Pricing Strategy Advisor course for the National Association of REALTORS® (NAR), as well as for other NAR courses, including RSPS.
In 2008, she was inducted into the REBAC Hall of Fame as an instructor, and in 2012, was named RSPS of the Year for her contributions to the RSPS course. In 2018, the Pennsylvania Association of REALTORS® named her REALTOR® of the Year. She continues to list, sell, and appraise properties, as well as teach.
