2023 Legislative Recap

Ohio’s lawmakers held their last sessions of 2023, marking an end to an extremely busy year in the Ohio legislature. The year began with a battle over who would become the next Speaker of the House of Representatives. In a surprise move, Rep. Jason Stephens (R-Kitts Hill), was selected speaker after partnering with the Democratic Caucus to receive more votes than Rep. Derek Merrin (R-Monclova Twp.), who had initially won an informal vote by House Republicans to take over the top position in the House. The battle over the speakership largely split the House Republican Caucus and created challenges for the new leadership team throughout much of 2023.
Shortly after the Speaker vote, lawmakers were tasked with passing the state operating budget, which funds state government operations for the next two years. Entering the budget process, there was an acute awareness of the housing crisis facing the state, and Ohio REALTORS® played a critical role in advocating for pro-housing policies aimed at investing in new housing supply, reducing barriers to new housing construction, and helping Ohioans obtain the financial resources to purchase a home of their own. Nowhere, however, was Ohio REALTORS® advocacy efforts more on display than in its efforts to spearhead the creation of a homeownership savings account program. The newly created initiative, called the Ohio Homebuyer Plus Program, would help homebuyers overcome financial barriers associated with purchasing a new home. This program would allow contributions to a homeownership savings account to be deducted from an individual’s state income taxes and, through partnering with the State Treasurer’s Office, the accounts will also receive above-market interest rates. The program, which has been a long-time priority for Ohio REALTORS®, shows Ohio’s commitment to helping Ohioans achieve the dream of homeownership, and we were proud to help lead the advocacy efforts that led to its creation. A complete list of legislative victories for Ohio REALTORS® in 2023 includes:
- Funding New Housing Development – Ohio REALTORS® successfully supported the creation of three new programs to address the housing shortage by investing in new housing development. The State Affordable Housing Tax Credit Program, the Single-Family Housing Tax Credit Program, and the Welcome Home Ohio Program will provide over $200 million per year in funding for affordable housing projects in Ohio.
- Reducing Taxes on Small Businesses – Ohio REALTORS® joined other business organizations to pass an exemption for businesses with gross receipts under $3,000,000 for calendar year 2024 and $6,000,000 in calendar year 2025 from filing and paying the Commercial Activities Tax (CAT).
- Protecting Housing Development Projects from Higher Taxes – A provision in the budget revises Ohio’s tax law to protect developers from higher taxes when they subdivide property for residential housing development.
- Removing Barriers for Housing Projects – Ohio REALTORS® successfully advocated to increase the threshold of signatures required to repeal township zoning plans.
- Defending the Ohio Housing Finance Agency (OHFA) – Ohio REALTORS® joined other advocates and successfully defeated efforts to eliminate OHFA and transfer its authority to a different state agency.
- Improving the Homestead Exemption – Language passed in the state operating budget will provide senior citizens and disabled Ohioans property tax relief by adjusting the homestead exemption for inflation each year.
- Defeated Efforts to Prohibit Rental Housing from Economic Development Incentives – Ohio REALTORS® coordinated with other stakeholders to oppose efforts in the operating budget that excluded rental units from development incentive programs like opportunity zones, community revitalization areas, and tax increment financing programs.
- Advocating for Consumer Protections – A coalition of stakeholders worked to protect Ohioans against long-term right-to-list home sale agreements, which locked homeowners into exclusive listing agreements in exchange for cash offerings.
- Opposed Cuts to Real Estate Licensing Requirements – Ohio REALTORS® opposed efforts by lawmakers to significantly reduce the hours of pre-licensing education for applicants for real estate salesperson and broker licenses.
- Protected Property Owners from Increases in Property Taxes – Ohio REALTORS® helped lead advocacy efforts to address concerns of growing property taxes resulting from skyrocketing property valuations.
- Modernize County Recorder Records – Ohio REALTORS® testified in support of legislation that would modernize electronic records and conveyances maintained by county recorders.
- Addressing the Housing Crisis – Ohio REALTORS® testified before a newly created Senate Select Committee on Housing and provided suggestions on ways to address the housing shortage facing the state.
- Improvements to the State’s Licensing System – Ohio REALTORS® advocated for legislation that would modernize the state’s licensing system and improve communication between state agencies and Ohio citizens.
- Defended Ohioans Against Home Equity Theft – Ohio REALTORS® backed legislation that will protect a property owner's equity by closing a loophole in Ohio’s tax foreclosure laws.
- Supported Appraisers in Foreclosure Sales – Ohio REALTORS® opposed efforts to remove independent appraisals from being used in property foreclosure sales.
- Pushed Back Against Federally Proposed Home Lending Fee Hikes – Along with other industry stakeholders, Ohio REALTORS® successfully advocated for the passage of a resolution urging the federal government to rescind its proposed loan level pricing adjustments that would raise fees on homebuyers.
- Protecting Consumers Against Wholesaling – Ohio REALTORS® worked with lawmakers on introducing legislation aimed at cracking down on unregulated wholesaling practices within the real estate industry.
As we look ahead to 2024 all eyes will be on the elections, which in addition to the presidential contest, feature several high-profile races in Ohio, including a US Senate seat, all 15 Congressional seats, 16 Ohio Senate seats, all 99 Ohio House of Representative seats, and three seats on the Ohio Supreme Court. While the legislative calendar is relatively light for the first half of 2024 due to the Primary Election in March, Ohio REALTORS® has many pressing legislative issues it will be pursuing.
We will be seeking changes to require written representation agreements for real estate brokers to ensure transparency throughout the home-buying process. Additionally, we will continue to defend against efforts to reduce Ohio’s educational requirements to become a licensed real estate professional. Ohio REALTORS® will work to enact changes to protect property owners from growing taxes as the state begins a review of its property tax laws. Ohio REALTORS® will advocate for consumer protections against unlicensed real estate wholesaling practices. Ohio REALTORS® will continue to work to ensure efforts to limit large institutional investments in Housing do not negatively impact housing providers and tenants. We will also work on policies that protect private property owners from local governments imposing excessive regulations on short-term rentals. Ohio REALTORS® will also continue to work with legislators to protect the industry from any unintended consequences resulting from efforts to limit foreign adversaries from purchasing property in Ohio.
